INFORMATIVA PRIVACY AI SENSI DEL CAPO III  SEZIONE 2 DEL REGOLAMENTO UE 2016/679 - DATENSCHUTZINFORMATION GEMÄSS KAPITEL III, ABSCHNITT 2 DER VERORDNUNG (EU) 2016/679 (DSGVO) – PRIVACY POLICY ACCORDING TO CHAPTER III, SECTION 2, REGULATION (EU) 2016/679

Nel rispetto della vigente normativa in materia di protezione di dati personali, La informiamo che la Euregio Plus SGR SPA (di seguito anche la “SGR") con sede in Passaggio Duomo 15, 39100 Bolzano (BZ) intende trattare dati personali che La riguardano in qualità di Titolare del trattamento, nell’ambito dell’attività prestata dalla SGR alla Sua persona.

In Übereinstimmung mit den geltenden Rechtsvorschriften betreffend den Schutz personenbezogener Daten teilen wir Ihnen mit, dass die Gesellschaft EuregioPlus SGR AG (nachstehend auch "SGR“ genannt) mit Sitz in der Dompassage 15, 39100 Bozen (BZ) beabsichtigt, die Sie betreffenden personenbezogenen Daten im Rahmen der von der SGR für Ihre Person erbrachten Tätigkeit zu verarbeiten.

In compliance with current legislation governing the protection of personal data, we would inform you that Euregio Plus SGR S.p.A. (hereinafter also the “SGR”), whose registered office is located at Passaggio Duomo 15, 39100 Bolzano (BZ), intends to process personal data concerning you as part of the activity carried out by the SGR in respect of yourself.

1. Titolarità - Datenverantwortlicher - Control 

Il Titolare dei trattamenti dei dati personali di cui alla presente informativa è la Euregio Plus SGR spa. 

Der Verantwortliche, der für die Verarbeitung der in diesem Informationsschreiben genannten personenbezogenen Daten zuständig ist, ist EuregioPlus SGR AG.

2. Profilo del trattamento - Profil der Datenverarbeitung - Processing profile

I dati personali relativi al trattamento di raccolta candidature e selezione del personale, oggetto della presente informativa sono limitati ai soli dati anagrafici, di contatto e, ove necessario, attestanti lo stato di salute e la posizione giudiziaria utili alla conclusione e gestione dei trattamenti previsti con la presente informativa.

I dati personali saranno elaborati su base giuridica connessa al codice civile, agli accordi contrattuali di categoria, a disposizioni regolamentari di carattere fiscale e giuslavoristiche, alla regolamentazione privacy in essere e comporteranno attività di gestione per svolgimento delle attività prestate dalla SGR 

Finalità del trattamento

I Suoi dati vengono trattati dal Titolare del trattamento esclusivamente per finalità di selezione del personale. Per tale finalità il conferimento dei dati è necessario e un mancato conferimento comporta, di conseguenza, l’impossibilità di dare seguito alla Sua candidatura. I dati raccolti per tale finalità sono conservati durante la fase di candidatura e selezione e per un massimo di due anni. I dati altresì sono raccolti per finalità, gestite per obbligo legale del titolare, correlate all'adempimento di obblighi imposti da leggi, regolamenti e disposizioni delle Autorità, normativa comunitaria. Per tale tipologia di attività la richiesta di consenso da parte Sua non è richiesta e il periodo di conservazione dei dati è subordinato alle indicazioni delle stesse Autorità.

Base giuridica del trattamento

La base giuridica del trattamento, ai sensi dell’art. 6 commi 1 lett. b) e c) del Regolamento (UE) 2016/679, sono l’esecuzione di un contratto di cui l’interessato è parte o all’esecuzione di misure precontrattuali e l’adempimento di obblighi legali e regolamentari cui è soggetta Euregio Plus. 

Trattamento di dati personali comuni

Nell'ambito della procedura di selezione il Titolare del trattamento raccoglie e tratta dati personali comuni necessari per valutare la candidatura e svolgere il colloquio di selezione, quali, a titolo esemplificativo, dati anagrafici, dati di contatto, informazioni relative al percorso di studi, alle esperienze professionali e alle competenze. Saranno inoltre trattati i dati personali comuni spontaneamente forniti dal candidato attraverso il curriculum vitae, la lettera di presentazione o altra documentazione trasmessa nell'ambito della candidatura, ivi comprese eventuali fotografie o altri contenuti multimediali allegati dal candidato. Il trattamento di tali dati è limitato a quanto necessario per lo svolgimento della procedura di selezione del personale.

Trattamento di categorie particolari di dati

Conformemente a quanto previsto dall’art. 9 del Regolamento (UE) 2016/679, al solo fine di valutare l’adeguatezza del Suo profilo professionale, (ove applicabile) il trattamento di categorie particolari di dati personali (quali a titolo esemplificativo quelli relativi al Suo stato di salute o appartenenza alle c.d. categorie protette) è necessario per assolvere gli obblighi ed esercitare i diritti specifici del Titolare del trattamento o dell'interessato in materia di diritto del lavoro e della sicurezza sociale e protezione sociale.

Die personenbezogenen Daten, die im Rahmen der Bearbeitung von Bewerbungen und der Personalauswahl erfasst werden, welche Gegenstand dieser Datenschutzerklärung sind, beschränken sich auf meldeamtliche Daten, Kontaktdaten und gegebenenfalls Daten betreffend den Gesundheitszustand und die Rechtsposition und dienen dem Abschluss und der Durchführung der in diesem Informationsschreiben vorgesehenen Datenverarbeitung.     

Die Verarbeitung der personenbezogenen Daten erfolgt auf einer Rechtsgrundlage, die sich auf das Italienische Zivilgesetzbuch, auf branchenspezifische vertragliche Vereinbarungen, auf steuer- und arbeitsrechtliche Vorschriften sowie auf die geltenden Datenschutzvorschriften stützt und umfasst Verarbeitungsvorgänge zur Durchführung der von der SGR geleisteten Tätigkeiten.

Zweck der Verarbeitung

Ihre Daten werden vom Verantwortlichen ausschließlich zum Zweck der Personalauswahl verarbeitet. Für diesen Zweck ist die Bereitstellung der Daten erforderlich; eine Nichtbereitstellung hat zur Folge, dass Ihre Bewerbung nicht berücksichtigt bzw. das Bewerbungsverfahren nicht fortgeführt werden kann. Die für diesen Zweck erhobenen Daten werden während der Bewerbungs- und Auswahlphase sowie für einen Zeitraum von höchstens zwei Jahren aufbewahrt. Darüber hinaus werden die Daten zu Zwecken erhoben, die aufgrund gesetzlicher Verpflichtungen des Verantwortlichen mit der Erfüllung von Pflichten zusammenhängen, die durch Gesetze, Verordnungen, behördliche Anordnungen sowie unionsrechtliche Vorschriften auferlegt werden. Für diese Verarbeitungstätigkeiten ist Ihre Einwilligung nicht erforderlich; die Aufbewahrungsdauer der Daten richtet sich nach den Vorgaben der zuständigen Behörden.

Rechtsgrundlage der Verarbeitung

Die Rechtsgrundlage der Verarbeitung gemäß Art. 6 Abs. 1 lit. b) und c) der Verordnung (EU) 2016/679 sind die Erfüllung eines Vertrags, dessen Vertragspartei die betroffene Person ist, bzw. die Durchführung vorvertraglicher Maßnahmen sowie die Erfüllung gesetzlicher und regulatorischer Verpflichtungen, denen Euregio Plus unterliegt.

Verarbeitung personenbezogener Standarddaten

Im Rahmen des Auswahlverfahrens erhebt und verarbeitet der Verantwortliche die für die Beurteilung der Bewerbung und die Durchführung des Bewerbungsgesprächs erforderlichen personenbezogenen Standarddaten, wie beispielsweise Stammdaten, Kontaktdaten, Informationen über den Bildungsweg, Berufserfahrungen und Qualifikationen. Darüber hinaus werden jene personenbezogenen Standarddaten verarbeitet, die der Bewerber freiwillig über den Lebenslauf, das Bewerbungsschreiben oder sonstige im Rahmen der Bewerbung übermittelte Unterlagen zur Verfügung stellt, einschließlich etwaiger Fotografien oder sonstiger vom Bewerber beigefügter Multimedia-Inhalte. Die Verarbeitung dieser Daten beschränkt sich auf das für die Durchführung des Personalauswahlverfahrens erforderliche Maß.

Verarbeitung besonderer Kategorien personenbezogener Daten

Gemäß Art. 9 der Verordnung (EU) 2016/679 ist, ausschließlich zum Zweck der Beurteilung der Eignung Ihres beruflichen Profils, gegebenenfalls auch die Verarbeitung besonderer Kategorien personenbezogener Daten (wie beispielsweise Daten über Ihren Gesundheitszustand oder Ihre Zugehörigkeit zu den sogenannten geschützten Kategorien) erforderlich, um die Rechte des Verantwortlichen oder der betroffenen Person im Bereich des Arbeitsrechts sowie der sozialen Sicherheit und des Sozialschutzes wahrzunehmen und die entsprechenden Verpflichtungen zu erfüllen... 

The personal data relating to the processing of the applications collected and the personnel selection referred to in this information note will be limited purely to personal data, contact data and, where necessary, data certifying the state of health or any convictions under the law helpful in concluding and administering the processing covered by this information note.

The personal data will be processed on the legal basis related to the Civil Code, to the relevant contractual agreements, to the regulatory provisions under the tax and labour laws, to current privacy regulation, and will involve the administration of the activities performed by the SGR.

Purpose of the Processing

Your personal data are processed by the Data Controller exclusively for personnel selection and recruitment purposes. For this purpose, the provision of personal data is necessary; failure to provide such data will make it impossible to proceed with your application.

Legal Basis for the Processing

Pursuant to Article 6(1)(b) and (c) of Regulation (EU) 2016/679, the legal basis is the performance of a contract to which the data subject is a party or the implementation of pre-contractual measures, as well as compliance with legal and regulatory obligations to which Euregio Plus is subject.

Processing of Ordinary Personal Data

Within the recruitment procedure, the Data Controller collects and processes the ordinary personal data necessary to assess the application and conduct the selection interview, such as, by way of example, identification data, contact details, information relating to educational background, professional experience and skills. The Data Controller will also process any ordinary personal data voluntarily provided by the candidate through the curriculum vitae, cover letter or any other documentation submitted as part of the application process, including any photographs or other multimedia content attached by the candidate. The processing of such data is limited to what is necessary for carrying out the recruitment and selection procedure.

Processing of Special Categories of Personal Data

In accordance with Article 9 of Regulation (EU) 2016/679, and solely for the purpose of assessing the suitability of your professional profile, the processing of special categories of personal data (where applicable), such as data relating to your health status or membership in protected categories, is necessary for carrying out obligations and exercising specific rights of the Data Controller or the data subject in the field of employment law, social security and social protection.

3. Verifica delle informazioni professionali - Überprüfung beruflicher Informationen - Verification of professional information

Nel corso della selezione, il Titolare potrà verificare le informazioni professionali fornite dal candidato, anche contattando le referenze da lui indicate nel curriculum vitae o nella candidatura, al solo fine di confermare esperienze professionali e competenze dichiarate, nei limiti di quanto strettamente necessario alla valutazione della candidatura. Queste attività non prevedono il trattamento automatizzato dei dati, inclusa la profilazione, secondo quanto previsto dall’art. 22 GDPR.

Während des Auswahlverfahrens kann der Verantwortliche die vom Bewerber angegebenen beruflichen Informationen überprüfen, einschließlich der Kontaktaufnahme mit den im Lebenslauf oder in der Bewerbung angegebenen Referenzpersonen, ausschließlich zum Zweck der Bestätigung der angegebenen Berufserfahrung und Qualifikationen und nur im Umfang, der für die Beurteilung der Bewerbung unbedingt erforderlich ist. Diese Tätigkeiten beinhalten weder automatisierte Entscheidungsfindungen noch Profiling im Sinne des Art. 22 DSGVO.

During the recruitment process, the Data Controller may verify the professional information provided by the candidate, including by contacting the references indicated in the curriculum vitae or application, solely for the purpose of confirming the declared professional experience and qualifications, and only to the extent strictly necessary for the assessment of the application. Such activities do not involve automated decision-making processes or profiling within the meaning of Article 22 GDPR.

4. Comunicazione e diffusione dei dati - Offenlegung und Verbreitung der Daten

Non è prevista alcuna forma di diffusione dei dati raccolti. I dati personali trattati per le finalità di cui sopra potranno essere comunicati alle seguenti categorie di soggetti:

  • soggetti interni della SGR preposti ai trattamenti attinenti l'area del personale;

  • soggetti interni della SGR interessati alla valutazione della candidatura;

  • persone fisiche e/o giuridiche, pubbliche e/o private (quali, a titolo indicativo e non esaustivo, fornitori di servizi informatici, hosting provider, fornitori di servizi cloud, soggetti incaricati della manutenzione e gestione dei sistemi informatici, studi di consulenza legale, amministrativa e fiscale, consulenti del lavoro), quando la comunicazione risulti necessaria o funzionale allo svolgimento della nostra attività e nei modi e per le finalità sopra elencate.;

  • soggetti Responsabili del trattamento ex art. 28 Regolamento (UE) 2016/679; 

  • soggetti di riferimento espressamente citati dal candidato quali referenze atte a confermare le competenze professionali dichiarate dal candidato

  • soggetti preposti da provvedimenti delle Autorità di vigilanza alla raccolta dati polizze per finalità statistiche, antifrode, antiriciclaggio, antiterrorismo.

  • soggetti controllanti e/o collegate alla SGR; 

  • Autorità pubbliche di controllo, vigilanza e di pubblica sicurezza.

Eine Verbreitung der erhobenen Daten ist nicht vorgesehen. Die für die oben genannten Zwecke verarbeiteten personenbezogenen Daten können folgenden Kategorien von Akteuren offengelegt werden:

  • Mitarbeiter der SGR, die an der Bewertung der Bewerbung beteiligt sind;

  • andere Unternehmensbereiche sowie natürliche und/oder juristische Personen des öffentlichen oder privaten Rechts (insbesondere, jedoch nicht ausschließlich, Anbieter von IT-Dienstleistungen, Hosting-Provider, Cloud-Dienstleister, mit der Wartung und Verwaltung von IT-Systemen beauftragte Unternehmen, Rechts-, Verwaltungs- und Steuerberatungskanzleien sowie Arbeitsrechts- und Personalberater), sofern die Weitergabe für die Durchführung unserer Tätigkeiten erforderlich oder zweckmäßig ist und ausschließlich auf die oben genannten Zwecke beschränkt bleibt;

  • Auftragsverarbeiter gemäß Art. 28 der Verordnung (EU) 2016/679;

  • den vom Bewerber ausdrücklich genannten Referenzpersonen, die die von ihm angegebenen beruflichen Fähigkeiten bestätigen können;

  • Personen, die aufgrund von Maßnahmen der Aufsichtsbehörden mit der Erhebung von Daten für statistische Zwecke, zur Betrugs-, zur Geldwäsche- und Terrorismusbekämpfung betraut sind;

  • herrschenden Unternehmen und/oder Unternehmen, mit denen die SGR ein Beteiligungsverhältnis hat;

  • öffentlichen Kontroll-, Aufsichts- und Sicherheitsbehörden.

It is not envisaged that the data collected will be disseminated in any form. The personal data processed for the above purposes may be communicated to the following categories of persons:

  • SGR personnel involved in the assessment and evaluation of the application;

  • other company departments, as well as natural and/or legal persons, public and/or private entities (including, by way of example and without limitation, IT service providers, hosting providers, cloud service providers, entities entrusted with the maintenance and management of IT systems, legal, administrative and tax advisory firms, and labour consultants), where such disclosure is necessary or instrumental to the performance of our activities and carried out solely for the purposes described above.

  • Data Processors pursuant to Article 28 of Regulation (EU) 2016/679;

  • persons expressly cited by the candidate as references to confirm his or her declared professional skills;

  • persons appointed by the supervisory authorities to collect data policies for statistical, anti-fraud, anti-money laundering or anti-terrorism purposes;

  • persons controlling and/or associated with the SGR;

  • public authorities with competence for control, supervision and puData processing methods, locationblic security.

5. Metodiche di trattamento dei dati- Methoden der Datenverarbeitung- Data processing methods

Le attività sui dati personali oggetto del trattamento saranno svolte mediante elaborazioni manuali e strumenti elettronici, seguendo rigorose prassi di sicurezza ispirate agli standard ENISA e alle indicazioni regolamentari finalizzate a limitare i rischi di perdita di riservatezza, integrità, disponibilità degli stessi.

I trattamenti e la conservazione dei dati saranno svolti in Italia.

Euregio Plus SGR S.p.A. non effettua alcun processo decisionale basato su trattamento automatizzato dei dati personali né effettua attività di profilazione. 

Die Verarbeitung der personenbezogenen Daten erfolgt durch manuelle Bearbeitung und mit elektronischen Hilfsmitteln, wobei strenge auf den ENISA-Normen und den gesetzlichen Vorschriften basierende Sicherheitsmaßnahmen zur Anwendung gelangen, um das Risiko eines Verlusts der Vertraulichkeit, der Integrität und der Verfügbarkeit der Daten zu begrenzen. Die Datenverarbeitung und -speicherung wird in Italien durchgeführt.

Die Euregio Plus SGR S.p.A. führt weder automatisierte Entscheidungsfindungen auf Grundlage personenbezogener Daten durch noch Profiling im Sinne der Datenschutz-Grundverordnung (DSGVO).

Data will be processed manually and by means of electronic tools in accordance with strict security practices based upon ENISA standards and regulatory guidelines aimed at limiting any risk of loss of the confidentiality, integrity or availability of the data.

The data will be processed and stored in Italy.

Euregio Plus SGR S.p.A. does not carry out any automated decision-making based on the processing of personal data, nor does it perform any profiling activities.

6. Diritti dell’interessato - Rechte der von der Datenverarbeitung betroffenen Personen - Rights of data subjects

L’interessato può esercitare in qualsiasi momento i diritti previsti dagli articoli 15 e seguenti del Regolamento (UE) 2016/679: 

  • Accesso: può ottenere informazioni a proposito del trattamento dei tuoi dati personali ed una copia di tali dati personali;

  • Rettifica: laddove lei ritenga che i suoi dati personali siano inaccurati o incompleti, può chiedere che tali dati siano rettificati o modificati seguendo le sue istruzioni;

  • Cancellazione: ha il diritto di richiedere la cancellazione dei suoi dati personali nei limiti in cui ciò sia possibile in conformità con l’art. 17 del Regolamento;

  • Limitazione: può richiedere la limitazione del trattamento dei suoi dati personali;

  • Opposizione: per motivi connessi alla sua situazione particolare, ha il diritto di opporti al trattamento dei suoi Dati Personali secondo quando previsto dall’art. 21 del Regolamento. 

  • Revoca del consenso: nel caso in cui il trattamento dei tuoi dati personali si basi sul consenso ha il diritto di revocare il suo consenso in qualsiasi momento;

  • Portabilità dei dati: ove il trattamento sia basato sul consenso, ha il diritto di ricevere in un formato strutturato, di uso comune e leggibile da dispositivo automatico i Dati Personali che ci ha fornito e, laddove ciò sia tecnicamente fattibile, alla trasmissione in sicurezza dei suoi Dati Personali ad un altro titolare del trattamento.

  • Berichtigung: Ist die betroffene Person der Ansicht, dass ihre personenbezogenen Daten unrichtig oder unvollständig sind, kann sie die Berichtigung oder Vervollständigung dieser Daten verlangen;

  • Löschung: Die betroffene Person hat das Recht, die Löschung ihrer personenbezogenen Daten zu verlangen, soweit dies gemäß Art. 17 DSGVO zulässig ist;

  • Einschränkung der Verarbeitung: Die betroffene Person kann die Einschränkung der Verarbeitung ihrer personenbezogenen Daten verlangen;

  • Widerspruch: Aus Gründen, die sich aus ihrer besonderen Situation ergeben, hat die betroffene Person das Recht, gemäß Art. 21 DSGVO Widerspruch gegen die Verarbeitung ihrer personenbezogenen Daten einzulegen;

  • Widerruf der Einwilligung: Soweit die Verarbeitung personenbezogener Daten auf einer Einwilligung beruht, hat die betroffene Person das Recht, diese Einwilligung jederzeit zu widerrufen;

  • Datenübertragbarkeit: Beruht die Verarbeitung auf einer Einwilligung, hat die betroffene Person das Recht, die von ihr bereitgestellten personenbezogenen Daten in einem strukturierten, gängigen und maschinenlesbaren Format zu erhalten und, soweit technisch möglich, deren sichere Übermittlung an einen anderen Verantwortlichen zu verlangen.

The data subject may exercise at any time the rights provided for under Articles 15 et seq. of Regulation (EU) 2016/679 (GDPR):

  • Right of access: the data subject may obtain information regarding the processing of his or her personal data and receive a copy of such personal data;

  • Right to rectification: where the data subject considers that his or her personal data are inaccurate or incomplete, he or she may request that such data be corrected or updated;

  • Right to erasure: the data subject has the right to request the erasure of his or her personal data to the extent permitted under Article 17 of the GDPR;

  • Right to restriction of processing: the data subject may request the restriction of the processing of his or her personal data;

  • Right to object: for reasons relating to his or her particular situation, the data subject has the right to object to the processing of personal data in accordance with Article 21 of the GDPR;

  • Right to withdraw consent: where the processing of personal data is based on consent, the data subject has the right to withdraw such consent at any time;

  • Right to data portability: where the processing is based on consent, the data subject has the right to receive the personal data provided to the Controller in a structured, commonly used and machine-readable format and, where technically feasible, to have such data transmitted securely to another controller.
